According to the Russians the incident took place as follows:
- 24.11. in the 16.40 were border guards of the RUSSIAN federation in the exclusive economic zone of the RUSSIAN federation identified the Ukrainian ships, bound for SV, towards Kerčskému strait.

- In 20.55 ship Izumrud in the coordinates 44°51'03.00"N 36°23'04.00"E opened fire on the boat Berdjansk.
- In 20.58 commander of the boat Berdjansk contacted the Russians, informed of the injured and asked for help.
- In 21.06 was Berdjansk detained ships Izumrud, picked up 7 sailors, including 3 of the wounded, who were given first aid.

Asi nevíme na jakou smlouvu se Ukrajinci odvolávali, zda-li na Rusko-Ukrajinskou o společném užívání Azovského moře anebo na mezinárodní o Námořním právu, resp. Mořském právu)?
Protože právo svobodné plavby se vztahuje pouze na civilní neozbrojené lodě (což nebyl tento případ, dle videí měl i remorkér lafetován kulomety, na palubě byli též ozbrojení vojáci), a za předpokladu, že dvoustranná dohoda taktéž upravovala přesun vojenských plavidel (asi nebude existovat stát, který po svém, společném anebo sporném území nechá courat cizí ozbrojené složky bez jakékoli kontroly), nějak nerozumím tomu vykříkování o právu svobodné plavby ...

- dle mezinárodního námořního práva: nejasnost "vlastníka" území Kerčského průlivu (spor Ruska a Ukrajiny), pokud se dané zeměm nejsou schopny dohodnout, nemůže být zaručeno právo proplouvání mezi jednotlivými moři a to včetně vojenských plavidel (jako je to v případě La Manche, Bospor a Dardanely, Gibralar, ...)
- pakliže Rusko považuje Krym za své území, může být (je) Ruskem oblast Kerčského průlivu vnímána jako teritorialní anebo vnitrostátní vody. V případě teritoriálních vod by pak (mohlo) platilo právo neškodného průjezdu, tj. volná civilní plavba, která ale může být ze strany Ruska regulována. Cokoli jiného je považováno za porušování ruských zákonů.
- COLREG, mezinárodní pravidla pro zabránění srážkám na moři (1972), analyzování videa z iDNES: a) právo vyhýbaní (remorkér by měl uhnout) v případě nejistoty b) loď, která je předjížděna musí toto uznat a udržovat kurz (což se nestalo, zatáčí vpravo), výsledkem je snaha kapitána lodě pobřežní strážce, který se v tuto chvíli snaží zabránit kolizi (uhýbání na záď), v okamžiku zjištění, že kolizi nelze zabránit nastavuje souběžný kurz k minimalizaci škod (následuje srážka). Vyhodnocení: ukrajinský remorkér udělal vše proto, aby ke srážce došlo (tj. viníkem je kapitán ukrajinského remorkéru, ať už z úmyslu či neúmyslně). Toť pohledem civilního námořního práva.

"Dohoda mezi Ruskou federací a Ukrajinou o spolupráci při využívání Azovského moře a Kerčského průlivu z roku 2003, článek 2:
„Obchodní lodě a válečné lodě, jakož i jiné státní lodě plující pod vlajkou Ruské federace nebo Ukrajiny, provozované pro nekomerční účely, využívají svobodu plavby v Azovském moři a v Kerčském průlivu.″"


Ruský politik a ekonóm Andrej Ilarionov na ruskej sociálnej sietii Livejurnal na základe publikovaných materiálov zostavil rekonštrukciu Kerčského incidentu z 23. – 26.11.2018, pri ktorom sa stretli ukrajinské a ruské lode pri Kerčskom prielive. V rovnaký deň bol článok publikovaný na ruskom serveri Echo Moskva.
